Interesting Facts: Montana State does NOT have a “legal limit” for blood alcohol concentration (“BAC”) in relation to legally driving a motor vehicle, and you do NOT have to be — DRIVING — a vehicle to be convicted of a DUI. Montana State Code provides that the offense of DUI occurs whenever: (1) a person is in control of a motor vehicle (this does not require driving, being behind the wheel, or the vehicle even being turned on); (2) they have consumed alcohol or drugs; and (3) the person’s ability to safely operate a motor vehicle was impaired — ANY AMOUNT or to any degree — by the consumption of the alcohol or drugs.
